By accessing or using any part of the site, and any associated websites, APIs, mobile applications, or retail products and/or services (collectively the “Mobilenig site & services”), you agree to be bound by these Terms of Service. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
1.1 Eligibility
Our website and services are not directed to children under 18. We do not knowingly transact or provide any services to children under 18.

To use Mobilenig, you have to register a Mobilenig account. You must register an account with your legal name, address, telephone number, e-mail address, and affirmation of your acceptance of the Terms of Service, Privacy Policy and Anti-money Laundering Policy before you can use our website & services.
You may not have more than one Mobilenig account. We may in our sole discretion, refuse you an account, limit your account, or permanently close your account if you are suspected to be in violation of any of the terms or for any other reason deemed necessary.
1.3 Verification and Know Your Customer
We are required by law to collect and verify certain personal information for identity verification purposes and the detection of money laundering, fraud, or other financial crimes. The personal information we are required to collect may include, but not limited to, your name, telephone number, e-mail address, physical address, date of birth, bank account information and bank verification number.

You authorize Mobilenig to, either directly or through third parties, verify your identity and/or protect against fraud through any inquiries we deem necessary. financial crime agencies and that these agencies may respond to our inquiries in full. This is an identity check only and should have no adverse effect on your credit rating.
We may, in our sole discretion, suspend or permanently close your account for any reason, including, but not limited to, if you are suspected of violating these terms, providing fraudulent or falsified information, and/or using your account in a prohibited way.
1.4 Information Update
If you change any information provided to us at registration including your name, address, phone number, email address, you agree to notify us of such change. We may be unable to respond to you if you contact us from an address, telephone number or email account that is not registered with us
1.5 Wallet and Funding
We operate an automated wallet system. This can be used to pay for any of our products and services. Funding the wallet is quite easy. It can be funded using any of the following means: Bank Transfer, ATM Card (online funding) and Airtime.
1.6 Unique Account Number
Having completed your Mobilenig account registration; you need to generate a unique Mobilenig account number. You can deposit or transfer fund into your unique MobileNig account number to get credited instantly. You can pay any amount, at any time, using any means (Website, Mobile App, USSD, ATM, POS etc.) to the unique MobileNig account number to credit your wallet instantly. This is subject to applicable charges.

Prices for our products and services are subject to change without notice.
1.8 Taxes
You are solely responsible for all taxes, which you are under a legal obligation to pay.
1.9 Account Security
You acknowledge and accept that you are completely responsible for protecting your account information,
which include but not limited to, your password, Mobilenig transaction pin, email address and telephone number. You are aware of phishing and spoofing attacks carried out through email, and you will carefully review communications to ensure they are legitimate and originate from us.
We assume no responsibility for any loss that may be sustained due to a compromise of your account, your personal information, or failure to follow communications delivered to you, or damages or interruptions caused by computer viruses, spyware, or other malware that may be contained in phishing attacks and messages.
Always access your Mobilenig account directly through our website to prevent any unauthorized access to your account.
If you believe your Mobilenig account has been compromised, you are uncertain about a message, or you suspect a phishing scam,
please report the situation immediately to mobilenigtech@gmail.com
Any automated means of accessing our services not approved and provided by us is expressly prohibited
1.9.1 Security Reminder
Mobilenig support teams will never ask you to divulge your password or Mobilenig transaction pin. Persons or messages asking you to reveal your login or password or transaction pin are illegitimate even if they seem to be legitimate. Be suspicious-- ignore or delete such requests.
1.10 Account Suspension and Permanent Closure
We may suspend, restrict,
or permanently close your Mobilenig account for any reason deemed necessary, including, but not limited to, a court or authorized governmental agency order;
heightened legal or regulatory risk to us; abuse of the Mobilenig account, system, or promotions; or inability of our partners to support your Mobilenig account.
You acknowledge and accept that we are not required to notify you of our actions or the reason,
and that the decision may be based on confidential criteria and information. You may close your Moblienig account at any time by contacting mobilenigtech@gmail.com
1.11 Disclaimer
We try to always keep Mobilenig available, bug-free, and safe. However, you use it at your own risk. Our website and services are provided “as is” without any express, implied and/or statutory warranties (including, but not limited to, any implied or statutory warranties of merchantability, fitness for a particular use or purpose, title, and non-infringement of intellectual property rights). Without limiting the generality of the foregoing, Mobilenig makes no warranty that our website and services will meet your requirements or that our website will be uninterrupted, timely, secure, or error free.
No advice or information, whether oral or written, obtained by you through our website or from Mobilenig, its parents, subsidiaries, or other affiliated companies, or its or their suppliers (or the respective officers, directors, employees, or agents of any such entities) (collectively, "Mobilenig parties") shall create any warranty.
1.12 Dispute Resolution and Waiver
We shall make an effort to settle all disputes amicably. Any dispute arising out of this Agreement which cannot be settled, by mutual agreement/negotiation shall be referred to arbitration, by a single arbitrator at the Oyo State Multi-Door Courthouse (“OYSMDC”) and governed by the Arbitration and Conciliation Act, Cap A10, Laws of the Federal Republic of Nigeria. The arbitrator shall be appointed by both parties (we and you). Where parties are unable to agree on the choice of an arbitrator, the choice of arbitration shall be referred to the OYSMDC. The findings of the arbitrator and subsequent award shall be binding on parties. Each of us shall bear our respective costs in connection with the Arbitration. Venue for the arbitration shall be Ibadan, Oyo State, Nigeria.
Parties (we and you) hereby expressly waive trial by any court proceedings and the right to participate in a class action lawsuit or class-wide arbitration. The prevailing party in the proceeding is entitled to reasonable costs and attorneys’ fees.
